Privacy Policy

1. Overview and Scope

This Privacy Policy (this “Privacy Policy”) describes how Smarter Dx, Inc., together with its affiliates (“SmarterDx”, “we”, “us”, or “our”), collects, uses, discloses, and protects personal information in connection with our public website located at www.smarterdx.com (the “Site”).

This Privacy Policy does not apply to information that we process on behalf of our enterprise customers (such as hospitals and health systems) while providing the SmarterDx services to them. Our use of that information may be governed by our agreements with such customers. If you have questions regarding personal information that we process on behalf of an enterprise customer, please direct your questions to that enterprise customer.

Our Site and the information on it are directed to enterprise customers and their representatives, and to other business visitors. We do not knowingly offer the Site for use by individuals in their personal, family, or household capacities, and we treat personal information we collect through the Site as pertaining to individuals acting in their capacity as business representatives.

Acknowledgment. By accessing or using the Site, you confirm that you have read, understand, and acknowledge this Privacy Policy. This Privacy Policy is incorporated by reference into our Terms of Service, available at www.smarterdx.com/legal/terms.

2. Personal Information We Collect

We may collect the following categories of personal information through the Site:

  • Business contact data, such as your name, email address, mailing address, professional title, company name, and phone number.
  • Communications data, based on our exchanges with you, including when you contact us through the Site, request information, or engage with our support team (“SmarterDx Support”).
  • Marketing data, such as your preferences for receiving our communications and your engagement with them.
  • Device and online activity data, such as your IP address, browser and device type, pages viewed, and how you interact with the Site, collected automatically through cookies and similar technologies.
  • Registered Portal information, such as the credentials and profile information you provide if you register for a Portal (including the Community Board), and any content you post there.
  • Text messaging data, if you opt in to SmarterDx Support's text-messaging program (see Section 8, SMS / Text Messaging).
  • Career and recruiting data, if you visit our careers page or apply for a position with SmarterDx (see Section 7, Careers Page).

3. How We Use Personal Information

We may use personal information collected through the Site to:

  • operate, maintain, and improve the Site;
  • communicate with you, including responding to inquiries and providing support;
  • administer Portals, including the Community Board, and verify eligibility for registered access;
  • send you information about SmarterDx's products and services, where permitted;
  • analyze and understand how visitors use the Site;
  • detect, investigate, and prevent security incidents and fraudulent or unlawful activity; and
  • comply with our legal obligations and enforce our Terms of Service.

4. Cookies and Similar Tracking Technologies

We and our service providers use cookies and similar technologies on the Site for the following purposes:

  • Necessary cookies, to support core Site functionality.
  • Analytics cookies, to help us understand how visitors use the Site.
  • Advertising cookies, to deliver interest-based advertising and measure its performance, as described below.

Interest-based advertising. We and our third-party advertising partners may use cookies and similar technologies to collect information about your interaction with the Site over time and across other websites, and to serve advertising we believe will be relevant to you. This activity may be considered a “sale” or “sharing” of personal information under the CCPA (defined below). California residents may opt out as described in Section 6 below.

We do not currently respond to browser “Do Not Track” signals, as there is no common industry standard for how to interpret them.

5. How We Disclose Personal Information

We may disclose personal information with:

  • our affiliates;
  • service providers who perform functions on our behalf (such as hosting, analytics, and email delivery);
  • advertising partners, for the interest-based advertising purposes described in Section 4;
  • professional advisors, such as lawyers, auditors, and insurers;
  • law enforcement or government authorities, where we believe disclosure is required or appropriate; and
  • a successor entity in connection with a merger, financing, acquisition, or similar transaction.

We do not sell personal information for monetary consideration. As described in Section 4, our use of advertising cookies may constitute a “sale” or “sharing” of personal information under the CCPA, which you may opt out of as described below.

6. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended (“CCPA”), provides you with the following rights with respect to personal information we collect through the Site:

  • Know and Access — the right to know what personal information we have collected about you and to request access to it.
  • Correction — the right to request that we correct inaccurate personal information.
  • Deletion — the right to request that we delete personal information we have collected about you.
  • Portability — the right to receive a copy of your personal information in a portable, and to the extent technically feasible, readily usable format.
  • Opt-Out of Sale/Sharing — the right to opt out of the sale or sharing of your personal information for cross-context behavioral advertising.
  • Limit Use of Sensitive Personal Information — the right to limit our use of any sensitive personal information we collect.
  • Non-Discrimination — the right not to be discriminated against for exercising any of these rights.

These rights do not apply to personal information that is subject to certain other legal regimes when held by us, such as protected health information that we hold as a business associate that is covered by the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (“HIPAA”).

You may opt out of the sale or sharing of your personal information by (1) using a Global Privacy Control opt-out signal on your browser or (2) using the “Do Not Sell or Share My Personal Information” link available on the Site. To exercise other rights listed above, please email us at privacy@smarterdx.com with the subject line “California Privacy Rights”. We may need to verify your identity before completing your request.

7. Careers Page

If you visit our careers page or apply for a position with SmarterDx, we may collect additional information about you, such as your contact information, resume or CV, employment history, education, qualifications, and, where you choose to provide it, demographic or equal-opportunity information. Job applications are processed through Greenhouse Software, Inc., our third-party applicant tracking platform, and are subject to Greenhouse's own privacy practices in addition to this Privacy Policy. We use information collected through the careers page to evaluate candidates, communicate with you about the recruitment process, and comply with our legal obligations.

8. SMS / Text Messaging

If you opt in to SmarterDx Support's text-messaging program, we collect your mobile phone number and the content of your text message exchanges with SmarterDx Support. We use this information solely to provide the support-related follow-up described in our Terms of Service, and we do not share your mobile number or SMS consent status with third parties for marketing purposes. Message and data rates may apply. You may opt out at any time by replying STOP, as described in our Terms of Service.

9. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information collected through the Site. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

10. Children's Privacy

The Site is not intended for use by anyone under 18 years of age, and we do not knowingly collect personal information through the Site from anyone under 18. If you believe a minor has provided us with personal information, please contact us using the information in Section 13 below.

11. Other Websites and Services

The Site may contain links to third-party websites. We are not responsible for the privacy practices of any third-party website, and we encourage you to review the privacy policy of any site you visit.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Changes are effective when posted to this page, and we will update the “Last Updated” date above. We encourage you to review this page periodically.
